What benefits does New York workers' compensation offer?

So, you've gotten injured at work. Although there are certain industries that are more likely to result in injuries, such as driving or construction work, anyone from a cashier to a secretary can suffer serious injuries while working.

Common forms of work-related medical issues include traumatic injuries as the result of an accident, painful conditions resulting from repetitive motion or improper back support and acquired illnesses from exposure to infectious agents or carcinogens while working. Many times, these conditions can result in severe pain, medical expenses and even an inability to work for some time.

Get the claims process going

If you are suffering from a work-related injury, it may be time to consider filing a claim for workers' compensation. If the condition is acquired over a period of time, you may need to work with your doctor to show that work is the primary cause.

If you suffered an accident that caused an injury while at work, you should report the accident to your employer as soon as possible after it happens. This will help if you need to file a claim for worker's compensation coverage in the future. You may be wondering what workers' compensation covers, and the answer is that it varies based on your situation.

Workers' compensation should protect your finances

The purpose of workers' compensation is to ensure that those who suffer work-related injuries do not end up impoverished or homeless as a result. New York has a relatively robust workers' compensation program that helps injured workers recover and return to work.

The most well known of those benefits is the payment of medical expenses. Generally, workers' compensation will cover all of your medical bills resulting from a work injury, usually without any deductible, co-insurance or copay. In order to receive these benefits, your injury or accident must get reported to your employer as soon as possible, and a claim must get filed in a timely manner.

Cash benefits

Another common benefit from workers' compensation is the cash benefit, which can start seven days after an injury. Doctors will determine what percent of disability you qualify for, given your condition. That percentage, multiplied with 2/3 of your average weekly wage, determines the amount of cash benefit you receive to offset your lost wages. If you are able to return to work but cannot work the same position for the same pay, you can receive 2/3 of the difference in your pay from workers' compensation.

In cases where a worker dies as the result of a work injury or illness, workers' compensation provides survivors' benefits to the workers' dependent family or, in cases without direct dependents, the parents of the worker may receive a one-time payment of up to $50,000.
